1. Introduction

These Terms and Conditions govern your purchase and use of music and audio files ("Content") from WAVjunkie. By purchasing Content, you agree to these terms.

2. License Grant

Upon purchase of Content from WAVjunkie, you are granted a non-exclusive, non-transferable license to use the Content subject to the following terms:

Permitted Uses

• Personal listening and enjoyment
• Use in personal, non-commercial projects
• Use in commercial projects (e.g., videos, podcasts, games) unless otherwise specified by the artist
• Creating derivative works for personal use

Prohibited Uses

• Reselling or redistributing the original Content files
• Claiming ownership or authorship of the Content
• Using Content in illegal, defamatory, or harmful contexts
• Sharing download links or files with third parties
• Using Content in AI training datasets without explicit permission

3. Payment Terms

All prices are displayed in USD unless otherwise specified. Payment is processed securely through Stripe. By completing a purchase, you authorize us to charge your payment method for the total amount.

• All sales are final and non-refundable
• Prices are subject to change without notice
• You are responsible for any applicable taxes

4. Refund Policy

Due to the digital nature of our products, all purchases are generally non-refundable. However, we may consider refunds in the following circumstances:

• Technical issues preventing download (after troubleshooting attempts)
• Duplicate purchases made in error
• Significant misrepresentation of the Content

Refund requests must be submitted within 7 days of purchase to [email protected]

5. Download Policy

Upon successful purchase, you will receive access to download your Content. Please note:

• Downloads are available in high-quality WAV format
• You are responsible for backing up your downloaded files
• Re-download access may be available through your account
• Download links should not be shared with others

6. Artist Payouts

Artists receive 80% of each sale (after the 20% platform fee) as outlined in the Artist Dashboard. All payouts are processed exclusively through Stripe Connect:

• A 20% platform fee is deducted from all sales before artist earnings are calculated
• Earnings are held for 7 days after each sale to allow for dispute resolution
• Stripe Connect required: Artists must complete Stripe's identity verification and connect a bank account to receive payouts. WAVjunkie does not store any sensitive financial information—all payment data is handled securely by Stripe.
• Minimum payout threshold: Artists must accumulate at least $25.00 USD in total earnings before requesting their first payout
• Quarterly payouts: After the initial $25 threshold is reached, payouts are processed on a quarterly basis (March, June, September, December)
• Payout requests are reviewed and processed within the first five business days of the processing month. Processing timelines may be extended in exceptional circumstances
• In the case of account deletion, balances below the $5.00 minimum processing threshold cannot be paid out. This amount contributes to WAVjunkie's operating costs, which help us keep the platform free for all artists. You'll be asked to confirm this before deletion proceeds.
• Artists are responsible for maintaining accurate information in their Stripe account and reporting income for tax purposes

WAVjunkie is a direct purchase platform, not a streaming service. Subscribers can preview tracks three times before buying. Revenue is not generated or paid out for these preview streams.

7. Content Availability

While we strive to maintain Content availability, we cannot guarantee that all Content will remain available indefinitely. Artists may remove their Content at any time, but your license to previously purchased Content remains valid.

8. Intellectual Property

All Content remains the intellectual property of the respective artists. Your purchase grants you a license to use the Content as specified, but does not transfer ownership or copyright.

9. Dispute Resolution

Any disputes arising from purchases will first be attempted to be resolved through direct communication. If resolution cannot be reached, disputes will be settled through binding arbitration in accordance with applicable laws.

10. Limitation of Liability

WAVjunkie's liability for any claim arising from your purchase is limited to the amount you paid for the Content in question. We are not liable for any indirect, incidental, or consequential damages.

11. Modifications

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting. Your continued use of the Platform after changes constitutes acceptance of the modified terms.
