    Terms of Service

    1. Acceptance of Terms

    By accessing or using WAVjunkie ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

    2. Eligibility

    You must be at least 18 years old to use WAVjunkie. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

    3. Account Registration

    To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

    4. Artist Accounts - Independent Artists Only

    WAVjunkie is exclusively for independent artists who are not currently signed to or represented by a record label. By registering as an Artist, you confirm that:

    • You are not signed to any record label or music distribution agreement that would conflict with your use of WAVjunkie
    • You own or have obtained all necessary rights to the music you upload
    • You have the legal authority to grant WAVjunkie the licenses described in these terms

    5. Master Use License

    By uploading music to WAVjunkie, you grant WAVjunkie a perpetual non-exclusive, worldwide, royalty-free master use license for the purposes of:

    • Hosting and storing your music on our servers
    • Streaming and playing your music to users of the Platform
    • Facilitating the sale and distribution of your music to purchasers
    • Promoting your music on the Platform and associated marketing channels

    You retain all ownership rights to your music. This license terminates when you remove your content from the Platform, except for copies already purchased by users. The master use license is perpetual unless you (the artist) removes your music or deletes their WAVjunkie Artist account. If either occurs, perpetuity is voided.

    6. Content Guidelines

    You agree not to upload content that:

    • Infringes on any third party's intellectual property rights
    • Contains unauthorized samples or copyrighted material
    • Is defamatory, obscene, or promotes illegal activities
    • Contains malware or harmful code

    7. Purchases and Payments

    All purchases are final. WAVjunkie processes payments through Stripe. Artists receive 80% of each sale (after the 20% platform fee). Payout terms:

    • Earnings are held for 7 days after purchase for dispute resolution
    • Minimum payout threshold: $25.00 USD must be accumulated before requesting payouts
    • Quarterly processing: After reaching the $25 threshold, payouts are processed quarterly (March, June, September, December)
    • Stripe Connect: All artist payouts are processed exclusively through Stripe Connect. Artists must complete Stripe's identity verification to receive payouts. WAVjunkie does not store sensitive financial information.
    • Artists are responsible for providing accurate information to Stripe and reporting income for tax purposes
    • In the case of account deleltion, balances below the $5.00 minimum processing threshold cannot be paid out. This amount contributes to WAVjunkie's operating costs, which help us keep the platform free for all artists. You'll be asked to confirm this before deletion proceeds.

    WAVjunkie is a direct purchase platform, not a streaming service. Subscribers can preview tracks three times before buying. Revenue is not generated or paid out for these preview streams.

    8. Intellectual Property

    The WAVjunkie platform, including its design, logos, and features, is owned by WAVjunkie and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Platform without permission.

    9. Termination

    We reserve the right to suspend or terminate your account for violations of these terms or for any other reason at our discretion. You may also close your account at any time.

    10. Limitation of Liability

    WAVjunkie is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

    11. Changes to Terms

    We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance of the new terms.
